14-Day Right of Return

11. RIGHT OF WITHDRAWAL FROM THE CONTRACT AND PROCEDURE FOR RETURNING AND EXCHANGING PRODUCTS
11.1. Right of Withdrawal from the Contract and Right to Replace the Product:
11.1.1. The Consumer/Buyer has the right to withdraw from the Contract within 14 (fourteen) days (from the date specified in paragraph 11.1.3) without giving reasons by notifying the Seller or TunedUp.eu, which will notify the Seller of the Buyer's decision to withdraw from the Contract. This right is exercised in accordance with the provisions of the Law of Obligations Act (§§ 56, 56¹, 56², 56³ of the Law of Obligations Act).
11.1.2. The consumer's right of withdrawal provided for in Section 56 of the Law of Obligations Act does not apply in the cases provided for in Section 53 (4) of the Law of Obligations Act. Among other things (without limiting other grounds provided for in Section 53 (4) of the Law of Obligations Act), the consumer does not have the right to withdraw from the Contract if:
a) the Goods are manufactured taking into account the consumer's personal needs;
b) the Goods are manufactured in accordance with the terms and conditions provided by the consumer;
c) the Goods are perishable or ageing;
d) the Goods were delivered in sealed packaging and were then opened after delivery and therefore cannot be returned for health or hygiene reasons;
e) the Goods are newspapers, magazines, or other periodicals, unless a contract for the duration of the order has been concluded for such Goods;
f) the Goods are audio or video recordings or software in a sealed case, if the consumer has opened the case.
g) The right of withdrawal does not apply to digital content, digital licenses, activation codes, subscription renewal codes, software, prepaid services, and other intangible digital products after they have been transferred to the Buyer or access to them has been granted.
11.1.3. The 14 (fourteen) day period for the right of withdrawal shall be calculated as follows:
a) in the case of a sales contract – from the date of receipt of the ordered Product by the Buyer or their designated person, excluding the carrier;
b) if the Buyer ordered more than one Product from different Sellers in a single order, and the Products are delivered separately, the period for exercising the right of withdrawal shall commence separately for each Seller on the date on which the Buyer or their designated person, excluding the carrier, receives the relevant Products from the Seller;
c) if the Products are delivered in different batches or parts, from the date of receipt of the last batch or part by the Buyer or their designated person, excluding the carrier;
d) If a contract is concluded for the regular supply of Goods for a specified period, from the date the Buyer or a person designated by them, excluding the carrier, receives the first Goods.
11.1.4. When canceling the Contract, the Buyer has the right to exchange the purchased Goods for a similar Goods of a different size, shape, color, model, or set. If a price difference arises during the exchange of Goods, the Buyer is obligated to settle with the Seller at the recalculated prices. The Buyer's notification of their desire to exercise their right to exchange the purchased Goods must be sent in the same manner as a notice of cancellation of the Contract.
11.2. Procedure for Cancellation and Exchange of Goods
11.2.1. The Buyer/consumer has the right to contact the specific Seller from whom the Goods were purchased or TunedUp.eu to cancel the Contract concluded with the Seller.
11.2.2. If the Consumer notifies TunedUp.eu of their withdrawal from the Agreement, the Consumer must do so in the following manner:
a) By submitting a withdrawal statement indicating their desire to withdraw from the Agreement.
11.2.3. Upon receipt of the Buyer's notice, TunedUp.eu will promptly send an acknowledgment of receipt and notify the Seller accordingly.
11.2.4. If the Buyer withdraws from the Agreement before the Goods are delivered, the Buyer must notify them by email at info@tunedUp.eu, by phone at +372 5586766, or by leaving a message using the form available on the TunedUp.eu website. The Buyer's notice constitutes withdrawal from the Agreement, and the Seller will be notified accordingly.
11.2.5. The Buyer is obligated to return the Goods no later than 14 days after submitting the withdrawal statement. The Buyer may return the Product by sending it to TunedUp.eu stores, returning it via couriers, directly to the Seller, or by mail. The Product must be returned to the Seller at the address specified on the invoice issued by the Seller to the Buyer, or via TunedUp.eu, which in turn will return the returned Product to the Seller. The procedure and conditions for delivering heavy items to the Seller (for quality assessment, replacement, repair, or return of the Product) are agreed upon separately between the Buyer and the Seller via TunedUp.eu by phone or email, or by the Buyer delivering the product directly to the Seller.
11.2.6. If the Buyer exercises their right to withdraw from the Agreement, the funds will be refunded within 14 (fourteen) days.
